Key Steps in the DOT RTD Process
Immediate Removal: The employee is immediately removed from all safety-sensitive functions.
SAP Evaluation: The employee must see a DOT-qualified Substance Abuse Professional (SAP) for a face-to-face assessment.
Treatment/Education: The employee must complete the education and/or treatment program recommended by the SAP.
Follow-Up Evaluation: The SAP conducts a second face-to-face evaluation to ensure the treatment plan was successfully completed.
Return-to-Duty Test: The employee must pass a negative, directly observed return-to-duty test administered by their employer or potential employer.
Follow-Up Testing Plan: Upon returning to work, the employee is subject to unannounced, observed follow-up tests, with at least six tests in the first 12 months, lasting up to 5 years.
Important Details
FMCSA Clearinghouse: CDL drivers with violations must have their status updated in the FMCSA Clearinghouse to "not prohibited" to resume driving.
The SAP's Role: The SAP determines when an employee is eligible to return to work, but cannot require the employee to use their treatment services.
Employer Responsibilities: Employers must provide a list of SAPs and ensure the employee completes the entire process.
Failure: Failure to complete the program or a positive return-to-duty test requires starting the entire process over.

How long does the RTD process take? The process cannot be rushed, and timelines vary from a few weeks to several months depending on the SAP's recommended treatment or education.

What if I change employers? If you have a violation (positive test or refusal) and move to a new employer, you must still complete the full DOT RTD process before working in a safety-sensitive position.
Are there follow-up tests? Yes. After returning to work, you are subject to unannounced follow-up drug/alcohol tests for up to 5 years.
How do I check my status? Once the SAP reports completion and the RTD test is negative, the employer reports this to the FMCSA Clearinghouse, changing the status from "prohibited" to "not prohibited".
What if I test positive on a non-DOT test? A positive test on a non-DOT test still requires you to complete the formal DOT RTD process before performing safety-sensitive duties.
