Key Steps in the DOT RTD Process

  1. Immediate Removal: The employee is immediately removed from all safety-sensitive functions.

  2. SAP Evaluation: The employee must see a DOT-qualified Substance Abuse Professional (SAP) for a face-to-face assessment.

  3. Treatment/Education: The employee must complete the education and/or treatment program recommended by the SAP.

  4. Follow-Up Evaluation: The SAP conducts a second face-to-face evaluation to ensure the treatment plan was successfully completed.

  5. Return-to-Duty Test: The employee must pass a negative, directly observed return-to-duty test administered by their employer or potential employer.

  6. Follow-Up Testing Plan: Upon returning to work, the employee is subject to unannounced, observed follow-up tests, with at least six tests in the first 12 months, lasting up to 5 years.

  • FMCSA Clearinghouse: CDL drivers with violations must have their status updated in the FMCSA Clearinghouse to "not prohibited" to resume driving.

  • The SAP's Role: The SAP determines when an employee is eligible to return to work, but cannot require the employee to use their treatment services.

  • Employer Responsibilities: Employers must provide a list of SAPs and ensure the employee completes the entire process.
